Pharmacy owner dies: continuation rights for spouse, parents and children

Mag. Bernhard Brandauer, Rechtsanwalt

Pharmacy owner dies: who may temporarily continue a public pharmacy, which age limits apply and what pharmacy students must prove.

After the death of the concession holder, a public pharmacy cannot automatically continue like an ordinary business. Section 15 of the Austrian Pharmacy Act provides a specific continuation right for the spouse or registered partner, parents, and children or adopted children in the first degree. The concession, the person entitled to continue and the account on which the pharmacy is operated must be reviewed separately.

The distinction from a lifetime family pharmacy transfer involving the concession and location helps with the first steps. The documents for the first succession consultation should be supplemented with the death certificate, estate file and evidence of the family relationship.

01 Question 1

Who is expected to continue the public pharmacy first after the death?

The family relationship, the estate and, for children, additional age and education evidence determine the review.

Overview of all answers.

01

Document the family relationship and the continuation account.

Bring together the death certificate, evidence of marriage or partnership or parent and child relationship, and the transfer documents. Then establish on whose account the pharmacy is being continued.

02

Review the child's age and education status separately.

Children are subject to specific age limits. In an ordinary pharmacy degree, a current study confirmation and proof of study progress of at least 15 ECTS credits must be submitted to the Austrian Chamber of Pharmacists every six months.

Keep the estate and the concession distinct until the proceedings end.

Until the estate proceedings have ended with legal effect, a public pharmacy may be continued on the account of the estate without a new concession. The operational responsibilities and file still need to be organised.

What section 15 of the Pharmacy Act regulates

Section 15(1) of the Austrian Pharmacy Act starts with a general rule: if a public pharmacy passes to another person by a transaction between living persons or by inheritance, operation is generally permitted only on the basis of a concession. The transfer of the business or the status as heir therefore does not replace the pharmacy law review.

After the concession holder's death, subsection 2 creates a narrowly defined exception. The spouse, registered partner, a parent or a child or adopted child in the first degree may have a continuation right. The phrase widow and orphan continuation is shorthand. The decisive point is the family group named in the statute.

Who falls within the continuation right

The continuation right is linked to the death of the concession holder and to the family relationships named in the statute. A sibling, a more distant relative or any person in the community of heirs does not become entitled to continue under section 15(2) solely by being an heir.

The review should therefore bring together the date of death, the concession, evidence of marriage or registered partnership or the parent and child relationship, and the transfer documents. Whether a new concession is required depends on the specific transfer and on the continuation right.

Which limits apply to children

For a spouse, registered partner or parent, the pharmacy may be continued on the account of the person entitled for no longer than five years after the pharmacy has passed. For children, the basic additional limit is completion of the 24th year of life.

Section 15(3) provides a separate extension logic for children who are ordinary pharmacy students, pharmacy trainees or pharmacists. The continuation right lasts until they obtain the qualification for independent operation under section 3 of the Pharmacy Act, but no later than completion of the 35th year of life. In an ordinary pharmacy degree, subsection 4 requires a current study confirmation and current evidence of study progress of at least 15 ECTS credits to be submitted to the Austrian Chamber of Pharmacists every six months. If the degree has not been completed by completion of the 29th year of life, the continuation right expires.

Continuation on the account of the estate

Until the estate proceedings have ended with legal effect, no new concession is required for the continuation of a public pharmacy on the account of the estate. Section 15(5) creates a transition phase for the pending proceedings. It does not automatically answer who manages the pharmacy day to day or which person may act towards authorities and contractual partners.

The estate file should therefore show the concession, the existing pharmacy operation, ongoing employment and supply relationships, the responsible persons and the communication with the Austrian Chamber of Pharmacists. Continuation on the account of the estate must be distinguished from later personal continuation by a family member.

Which documents should be assembled before continuation

The first file should contain the death certificate, concession documents and evidence of the family relationship. It should also show the status of the estate proceedings, who is expected to continue the pharmacy and on whose account, and, for children, the relevant age and education evidence.

For an ordinary pharmacy degree, the six-monthly evidence under section 15(4) must be placed in the correct timeline. The file should also record when the pharmacy passed, which age limit applies and whether any evidence is missing. This keeps visible whether the issue is the continuation right, a new concession or another form of pharmacy law authorisation.

Distinction from a lifetime pharmacy transfer

A transfer between living persons and continuation after the concession holder's death have different legal starting points. In a lifetime succession, the transfer agreement, concession, location and the successor's specific authorisation are central. Death activates the special rule in section 15 of the Pharmacy Act.

A legacy, forced heirship and the economic division of the estate may also matter to the family. They do not replace the review of whether the person acting is within the continuation right and which statutory limit applies to the continuation.

Frequently asked questions about pharmacy continuation after a death

Can every child of the deceased concession holder continue the pharmacy?

Section 15 of the Pharmacy Act names children and adopted children in the first degree. The specific continuation also requires a review of the transfer, the age limit and, for pharmacy students, the additional evidence.

Does the five-year limit apply to every child?

For children, the basic limit is completion of the 24th year of life. For a child who is a pharmacy student, trainee or pharmacist, section 15(3) provides a special rule until the qualification for independent operation, at most until completion of the 35th year. The degree must be completed by the statutory age of 29.

Does the estate immediately need a new concession?

Until the estate proceedings have ended with legal effect, section 15(5) does not require a new concession for continuation of the public pharmacy on the account of the estate.

Does the person entitled to continue automatically own the pharmacy?

The continuation right governs pharmacy law operation. Inheritance ownership, legacies and forced heirship are separate questions.
